This “Privacy Policy” regulates the processing of your personal data by Belvico Food, 't Kamp 10, 8700 Tielt and registered in the CBE under number BE0772.84.94.78.

ARTICLE 1 – GENERAL

Belvico Food complies with the European Regulation 2016/679 of 27 April 2016 on the protection of personal data, as well as with the anti-spam provisions and provisions regarding contracts concluded by electronic means from Book XII of the Code of Economic Law on the law of the electronic economy.

 

ARTICLE 2 – PERSONAL DATA

  1. Personal data you share with us:

    1. Category 1: without registration on the website: your IP address and cookies using Google Analytics

    2. Category 2: your name, first name, e-mail address, telephone number (if any), address (if any) and any other personal information you have entered in our contact form on the website or in your e-mail addressed directly to us.

    3. Category 3: your name (if any), first name (if any) and e-mail address when you sign up for our newsletter via the website.

    4. Category 4: your gender, surname, first name, e-mail address, telephone number, delivery address, company and VAT number (if any) when you place an order via the website.

  2. Belvico Food can collect data from you in various ways:

    1. By using cookies.

    2. When you provide personal information to use the website.

    3. When you provide personal data that is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject before entering into a contract.

    4. Your communication data, any data shared by you when you communicate with us via email, online, telephone, social media or any other form.

    5. Your data in lotteries, campaigns, competitions or trial campaigns.

    6. Your ratings, reviews and feedback. Opinions, experiences, preferences and interests and product reviews that you post on our website or online or via social media.

 

 

ARTICLE 3 – PURPOSES OF PROCESSING

 

Belvico Food will only use your collected personal data for the following purposes:

  • Taking care of and improving the website and including personal data in anonymous statistics, from which the identity of specific persons or companies cannot be traced, with the legitimate interests of BELVICO FOOD as the legal basis to continuously improve its website and services.

  • Replying to the message you send us through our contact area. With your explicit consent as the legal basis.

  • Sending our newsletters and targeted advertisements with your express prior consent as a legal basis.

  • Sending your order on the legal basis of the performance of an agreement that you have requested.

  • You are not obliged to disclose your personal data, but understand that the provision of certain services becomes impossible if you refuse the processing.

If you are already included in our mailing list to receive marketing materials in paper and/or electronic form, Belvico Food may use your data to send marketing and other materials related to Belvico Food, its products and/or services. Belvico Food may use the information you provide to update documents stored by Belvico Food. This consent can be withdrawn at any time, without justification and free of charge, for example by clicking on the unsubscribe link provided for this purpose at the bottom of every promotional e-mail message.

 

Transfer to third parties:

In the event of a complete or partial reorganization or transfer of Belvico Food's activities, whereby it reorganizes, transfers, ceases its business activities or if Belvico Food goes bankrupt, this may mean that your data is given to new entities or third parties through which the business activities of Belvico Food are wholly or partly performed are transferred.

Belvico Food will make reasonable efforts to inform you in advance of the fact that Belvico Food will disclose your data to said third party, but you also acknowledge that this is not technically or commercially feasible under all circumstances.

 

Belvico Food may share your category 4 data with the entity or third party responsible for the pick-up address chosen by you when placing an order. Belvico Food ensures that this third party (independent distributor of Belvico Food) will also respect this privacy policy and will only use your data for the purpose described in article 3 for the data concerned (category 4). Belvico Food can of course also share the same data with a logistics service provider that it relies on in the context of delivery to the address specified by you.

 

Belvico Food will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described above or without your prior consent.

 

Legal requirements:

In rare cases, Belvico Food may be required to disclose your Personal Data pursuant to a court order or to comply with other mandatory laws or regulations. Belvico Food will make reasonable efforts to inform you in advance in this regard, unless this is subject to legal restrictions.

 

ARTICLE 4 – DURATION OF PROCESSING

 

The personal data is stored and processed by us for a period that is necessary in function of the purposes of the processing and in function of the contractual relationship between Belvico Food and you.

 

If you apply for a position at Belvico Food and you provide us with your personal data in that context, we will keep this personal data at least until the end of the application procedure.

If your profile can be considered for future vacancies and in order to be able to contact you where appropriate, we will keep your data for 1 year after your application.

 

If your profile does not qualify and you are not offered a position, we will delete your personal data from our systems at the end of the application procedure.

 

ARTICLE 5 – YOUR RIGHTS

 

  1. Right of access and inspection: You have the right to take cognizance of your personal data at any time free of charge, as well as the use that we make of your personal data.

  2. Right of correction, deletion and limitation: you are free to decide whether or not to communicate your personal data to Belvico Food. In addition, you always have the right to request us to improve your personal data, to supplement or to remove personal data, if certain services and products are not available.

  3. Right to object: you also have a right to object to the processing of your personal data for serious and legitimate reasons. In addition, you always have the right to object to the use of personal data for direct marketing purposes; in such case you do not have to give reasons.

  4. Right of free data portability: you have the right to obtain your personal data processed by us in a structured, commonly used and machine-readable form and/or to transfer it to other responsible parties,

  5. Right to withdraw consent: to the extent that the processing is based on your prior consent, you have the right to withdraw that consent.

  6. Exercising your rights: You can exercise your rights by contacting us or by emailing customercare@belvico.com .

  7. Automatic decisions and profiling. This implies that Belvico Food can send you personalized offers and advertisements based on your purchase history. You always have the right to object to this profiling free of charge. You can do this by sending an email to customercare@belvico.com

  8. Right to lodge a complaint: You have the right to lodge a complaint with the Belgian Data Protection Authority, Data Protection Authority, Drukpersstraat 35, 1000 Brussels; +32 (0)2 274 48 00; +32 (0)2 274 48 35 or contact@apd-gba.be . This is without prejudice to a remedy before a civil court. If you suffer damage as a result of the processing of your personal data, you can file a claim for compensation

 

ARTICLE 6 – SECURITY AND CONFIDENTIALITY

We have developed security measures that are adapted from a technical and organizational point of view to avoid the destruction, loss, falsification, modification, unauthorized access or incorrect disclosure to third parties of personal data collected as well as any other unauthorized processing of this information.

  2. Under no circumstances can Belvico Food be held liable for any direct or indirect damage resulting from incorrect or unlawful use by a third party of the personal data.

  3. You must comply with the security regulations at all times, including by any unauthorized access to the website. You are therefore solely responsible for the use made from the website of your computer, IP address and your identification data, as well as for their confidentiality.
